Política de Tratamiento de Datos Personales
1. Identificación del Responsable
- Razón Social: THE FASHION CREW GROUP S.A.S.
- NIT: 901.995.981-8
- Geolocalización: mostrar marcas, tiendas y eventos cercanos.
7. Compartición con Terceros
The Fashion Crew Group NO vende datos personales.
14. Contacto
Privacy Policy
1. Controller Identification
- Company: THE FASHION CREW GROUP S.A.S.
- Tax ID (NIT): 901.995.981-8
- Headquarters: Bogotá D.C., Colombia
- Data Protection Email: privacy@fashioncrewai.com
- Responsible: Privacy & Compliance Team
2. Legal Framework and Scope
This policy is governed by Colombia's Law 1581 of 2012 (Personal Data Protection), Decree 1377 of 2013, and Resolution 8.109 of 2022. For future EU/EEA expansion, GDPR (2016/679) will apply.
It applies to personal data collected through the FashionCrewAI mobile app and its modules: ALAIA Chat, Fashion Map, FC News, FC Events, FC Jobs, Creatives (including Creative Pass and Opportunities), and User Profile, and to creatives' public pages at fashioncrewai.com/c/ (also regarding people who visit them without an account).
3. Data Collected
3.1 Data provided by the user
- Registration data: full name, email, city of residence
- Authentication data: password (secure hash), sessions
- Profile photo (stored in Firebase Storage)
- Profile questionnaire: age range, country and city, profession, relationship with fashion, styles and interests
- Creative profile (only if you apply): public name, photo, photos of your work, bio, roles, city, country, Instagram, links and the kind of projects you are open to; with Creative Pass, also a video; and an optional phone number, which only the team sees to contact you about your profile and which is not published
- Features for creatives (only if you use them): the contact details you turn on for the Contact button (WhatsApp and/or email), the address you choose for your public page and the record of when you turned it on or off, your verification request and your applications to opportunities (public name, photo, role, city, Instagram and your message). See section 4.2
- Recommendations you write: the name you write, your relationship to the creative and the text (see section 4.2)
- Content you submit through the feedback channel (category, message, and optional screenshot)
3.2 Data collected automatically
- Real-time geolocation (GPS) for Fashion Map, only if you grant the phone's location permission
- ALAIA conversations: your questions, the answers, the recommended brands, and the profile data the app sends with each query (city, styles, interests, relationship with fashion), and your first name so ALAIA can greet you (not kept in the history). Images you attach are used only to answer and are deleted afterwards (see 4.1).
- App interactions (searches, screens, usage time) via Firebase Analytics
- Creative profile visits: when you open a creative's profile or tap their Instagram, one of their links or their WhatsApp or email button, we record your user ID, the profile, the type of interaction and the date; for visits, also where you came from (directory, search, ALAIA, Home, a shared link or other) and your profile's city, if you entered one. It is used only to calculate the aggregate statistics the creative sees (for example, visits by day, month, city and source); the creative never sees who visited them. The individual record is deleted after 2 days.
- Visits to creatives' public pages (fashioncrewai.com/c/): when someone opens a public page, the page records the visit with only the page address and the time, without IP address, cookies or any identifier of the person; it is added to the creative's statistics and the record is deleted as soon as it is added. So the same visit is not counted twice in one day, the browser stores locally the date of the last visit to that page; that data never leaves the device.
- Crew creatives in ALAIA: if your question is looking for a creative, we use the role and city you mention (or, if you do not mention a city, the one in your profile) to show you up to 3 Creative Pass creatives; they are saved with that answer in your account and are not added to the history in section 4.1.
- Performance and network latency metrics (Firebase Performance Monitoring)
- Push notification token (Firebase Cloud Messaging)
- Technical data: OS version, device model, device ID, masked IP, session tokens
- Crash reports (Firebase Crashlytics)
3.3 Third-party data
- Google Sign-In: name, email, profile photo (if you authorize)
- Sign in with Apple: name and email (or an Apple relay email), if you choose that method
- Crew Pass and Creative Pass purchases (Apple App Store / Google Play, through RevenueCat): your subscription status (plan —Crew Pass or Creative Pass—, validity and renewal); we never receive your card details. If we give you a courtesy plan, we store its end date and an internal note from our team
- Device location services
4. Purpose of Processing
- Authentication & security: create and maintain your account, validate identity, recover password.
- Personalization: optimize the ALAIA AI and generate recommendations based on your preferences and location.
- Geolocation: show nearby brands, stores, and events.
- Communication: event notifications and policy change alerts.
- AI processing (ALAIA): the content you send to the chat (text and images) is processed by third-party large language model (LLM) providers to generate responses (see section 7).
- Analysis & improvement: usage metrics, error resolution, and service improvement.
4.1 ALAIA conversation history
We keep a history of your conversations with ALAIA. We ask for your authorization for this purpose when you accept this version of the policy, and we only keep the conversations of users who accepted it.
- What we keep: your questions, ALAIA's answers, the recommended brands, and the profile data the app sends with each query (city, styles, interests, and relationship with fashion), with the date, language, platform, app version, plan type, and technical data about the result. We do not keep images: we only note that the query included one.
- How: under a pseudonymous identifier (a code that does not contain your name or email). Access is restricted to authorized Fashion Crew staff, who may link it to your account only to handle your requests.
- What for: improving the service and the quality of answers; producing statistics and trend analysis; and carrying out that analysis with the help of artificial intelligence tools from technology providers (for example, Google Cloud / Vertex AI or OpenAI), which act as data processors under contracts that forbid them from using the data to train their own models.
- How long: up to 2 years from each conversation; after that it is deleted automatically.
- Deletion, withdrawal and access: the history is deleted with your account. You can also withdraw this authorization, ask us to delete it, or request a copy by writing to privacy@fashioncrewai.com; if you withdraw it, we stop keeping your conversations and delete the earlier ones.
- Anything we share with third parties based on this analysis will always be aggregate statistics that do not identify you.
4.2 Creative Pass and features for creatives
These features are optional. Those that publish your data or share it with other people are only turned on if you decide so, with a specific notice at that moment; that is how you give us your prior, express and informed authorization for that purpose (Colombian Law 1581 of 2012 and Decree 1377 of 2013), and you can withdraw it at any time in the app.
- Public page: if you turn it on, we publish at fashioncrewai.com/c/ (followed by the address you choose) your public name, photo, roles, city and country, bio, the kind of projects you are open to, photos, video, Instagram, links, the verified badge and up to 3 approved recommendations (author name, relationship and text). It is visible to anyone on the internet, without an account, and search engines may index it and keep copies. It never includes your phone number, your email, your WhatsApp, your statistics or your account ID. The links to your photos and video are hosted by our storage provider, and their web addresses may contain an internal technical code of your account that does not reveal personal data by itself. We keep a record of each time you turn it on or off, as proof of your authorization. You can turn it off at any time; it is also turned off if your Creative Pass ends, if we remove your profile from the directory or if you delete your account. When it is turned off we remove it from our site immediately; copies kept by search engines or other sites may take time to disappear and are beyond our control (you can ask them to remove them, and we will help if you write to us).
- Contact button: if you turn it on, we store the WhatsApp number and/or email you choose (the app may suggest your account's phone number, but it is only stored for this purpose if you confirm it). Only people signed in to FashionCrewAI see it, while you have Creative Pass and your profile is approved; it never goes on your public page.
- Recommendations: if you write one, we store your user ID, the name you write, your relationship to the creative, the text, its status and its dates. The creative sees all of them in order to decide whether to approve them; if approved, your name and your text are shown on their profile to signed-in users and, if they have a public page, on it, visible on the internet. We tell you this before you send it, and you can edit or delete it at any time.
- Portfolio video: we treat it like your portfolio photos, to show it on your profile and, if you turn it on, on your public page. If you replace it, we delete the previous one.
- Statistics for the creative: from the visit records in section 3.2 we calculate aggregate figures by day, by month, by visitor city, by source and by type of tap. The city and the source are used only for that same purpose, which you authorized when you accepted this Policy; cities that are not on our list are grouped as “other”. The creative never sees who visited them or who tapped their buttons.
- Opportunities and applications: when you apply, we store your public name, photo, role, city, Instagram, your message, the date and the status of the application, with an internal note from our team. We share that data and your creative profile with the brand or third party that posted the opportunity, so it can assess you; we tell you before sending it. Once it receives the data, that brand or third party processes it as a controller, under its own privacy policy. You can withdraw your application while it is still marked as sent.
- Verification: if you request it, we store the request, its result and an internal note, and we review your Instagram account; we may write to you to confirm that it is yours.
- Creative of the week and creatives in ALAIA: if you have Creative Pass, we may show your public name, photo, role, city and badge as Creative of the week on Home and below ALAIA's answers to other users, always inside the app. This is data already visible in the directory.
- PDF kit: it is generated on your phone with the data you choose; we do not keep it on our servers.
- Partner discounts: we do not share your data with partners. If you use a code or a link, the relationship is between you and the partner, under its privacy policy.
5. Data Security
We implement encryption in transit (TLS 1.3), encryption at rest, per-user access control, Firebase Authentication, and Firebase App Check to verify requests come from the official app. Providers are SOC 2 certified (Google Cloud / Firebase).
6. Data Retention
- Active account data: while you keep the account.
- ALAIA conversation history: up to 2 years from each conversation, with a pseudonymous identifier (see 4.1); deleted earlier if you delete your account or ask us to. Attached images are not kept.
- Creative profile visits: the individual record, 2 days; aggregate figures, while the profile exists (up to 90 days of daily detail and 12 months of monthly detail).
- Public Page Visits: each visit record is deleted as soon as it is added to the statistics; only aggregate figures remain
- Public Page: while it is turned on; it is removed when you turn it off, when your Creative Pass ends, if we remove your profile from the directory or when you delete your account. The record of turning it on and off is kept while your account exists
- Contact Button Details: until you remove them or delete your account; if your Creative Pass ends, they stop being shown
- Portfolio Video: like photos, until you delete or replace it, or delete your account
- Recommendations: while the creative's profile and the author's account exist, unless the author deletes it earlier or we remove it for breaking the rules
- Applications to Opportunities: up to 12 months after the opportunity closes; earlier if you withdraw it or delete your account. What the brand or third party that posted it already received is governed by its policy
- Verification Request: while your creative profile exists
- After account deletion: data deleted within 30 days (except legal obligations).
7. Sharing with Third Parties
The Fashion Crew Group DOES NOT sell personal data. We share it with providers acting as data processors:
- Google / Firebase and Google Cloud: authentication, database, storage, analytics, notifications, and crash reporting.
- AI processing (ALAIA): the content you send to the chat (text and images) is transmitted through our AI orchestration provider and to one or more third-party large language model (LLM) providers, solely to generate responses. These providers process the data under their own privacy policies.
- ALAIA history analysis (section 4.1): Google Cloud (BigQuery and Vertex AI) stores and analyzes it; for specific analyses we may also use OpenAI. They act as data processors and may not use the data to train their own models.
- Apple, Google and RevenueCat: management of Crew Pass and Creative Pass purchases and subscriptions. RevenueCat receives an identifier of your account and the status of your purchases; payments are processed by Apple or Google and we never receive your card details.
- Authorities: when legally required.
Apart from your application data when you decide to apply for an opportunity, brands only see aggregated, anonymized statistics, and discount partners do not receive your data.
7.1 People who see your data because you decide so
- Anyone on the internet: what your public page shows, only if you turn it on (section 4.2)
- Users signed in to the app: your approved creative profile, your contact details if you turn on the Contact button, and the recommendations you write if the creative approves them
- The brand or third party that posted an opportunity: your application data and your creative profile, only if you apply; once it receives them, it processes them as a controller under its own privacy policy
8. International Transfers
We use servers in the United States (Google Cloud / Firebase, where the ALAIA history is also stored), and the AI providers referenced in section 7 may also process data outside Colombia. By using the app, you authorize the transfer of data to these jurisdictions, subject to equivalent protection safeguards.
The Creative Pass features do not add new providers: they use the same Google Cloud and Firebase infrastructure. Your public page, if you turn it on, can be viewed from any country. If you apply for an opportunity from a brand or third party located outside Colombia, your application data reaches that country because you decide to send it.
9. Your Rights
You may access (including your ALAIA conversation history), update, rectify, and erase your data, withdraw consent, request portability, and object to specific processing. You can also delete your account directly in the app (Profile → My account → Delete account). In addition, in the app you can turn off your public page, remove your contact details, edit or delete your recommendations and withdraw an application that is still marked as sent.
10. Exercising Your Rights
Email privacy@fashioncrewai.com with the subject "DATA SUBJECT REQUEST - [Your Name]". Response times: queries within 10 business days and complaints within 15 business days (Colombian Decree 1377 of 2013). You may also file a complaint with the SIC (www.sic.gov.co).
See the account deletion instructions, including the email option if you cannot access the app.
11. Minors
FashionCrewAI does not allow users under 18. If we detect a minor's account, it will be deleted.
12. Cookies and Tracking
We use session tokens (JWT), Firebase Analytics (anonymized data), and location data. You can disable location tracking in your device settings without affecting core features.
Creatives' public pages on fashioncrewai.com do not use cookies or analytics tools: they only store in your browser the date of your last visit to each page, so it is not counted twice on the same day (section 3.2).
The app does not show ads and does not track your activity across other companies' apps or websites for advertising (we do not use the device's advertising identifier).
13. Policy Changes
We may modify this policy. Non-substantial changes (wording, clarifications) apply from publication. Substantial changes (for example, new purposes, new types of data or new recipients) will be notified in the app before they apply, and we will ask you to accept them again; if they involve a new purpose, we will only use your data for it with your authorization. When a new, optional feature needs new data or new recipients (for example, publishing your public page or sending an application), we ask for that authorization specifically when you turn it on or use it, and we only process that data if you give it.
